Terms of Service
These terms are an agreement between you and Komers Sites operator (set LEGAL_COMPANY_NAME) ("we", "us") for the use of Komers Sites, a service that lets you build and host websites on udx.my using an AI app. By creating an account or signing in, you agree to these terms and to our Privacy Notice.
1. Your account
You must be at least 18 and able to enter into a binding contract. You are responsible for everything done through your account, including by AI apps you connect. Keep access to your email and connected AI apps secure, and tell us promptly at — if you suspect misuse.
2. Credits and payment
- New accounts receive 20 free credits. Credits can be bought in packs (RM15 = 15, RM30 = 35, RM50 = 75) through FPX, DuitNow QR, Touch 'n Go eWallet, GrabPay or card. 1 credit is roughly RM1.
- Publishing a site costs 5 credits for each 30 days of hosting. Hosting renews automatically while the site is published. If there are not enough credits to renew, we will email you and unpublish the site after 3 days; your pages and data are kept.
- Credits are prepaid, have no cash value and are not transferable. Purchased credits are non-refundable and unused hosting time is not refunded, except where Malaysian law requires a refund or where we fail to provide the service through our fault.
- We may change prices or credit costs with at least 30 days' notice by email. Changes do not affect hosting periods already paid.
3. Your content and your visitors
You own the content on your sites. You give us a licence to store, copy, display and deliver it only as needed to run Komers Sites. You are responsible for your content, including content your AI app generates for you: review it before publishing, and make sure it is accurate and lawful.
When your site collects personal data from visitors (for example through forms or visitor sign-in), you are the data controller for that data. You must have a lawful basis to collect it, tell visitors how it is used (for example with a privacy notice on your site), respond to their requests, and comply with the PDPA. We process that data on your behalf as described in our Privacy Notice.
4. Acceptable use
You must not use Komers Sites, or let your AI app use it, to:
- run phishing, scams, fake shops, investment or money-game schemes, or collect passwords or payment card details;
- impersonate any person, company, bank, government agency or brand;
- publish content that is illegal in Malaysia, including content prohibited under the Communications and Multimedia Act 1998, unlicensed gambling, and content that sexually exploits children;
- infringe copyright, trademarks or other rights;
- distribute malware, send spam, or attack, overload or probe our systems or others';
- harass, threaten or incite hatred or violence against anyone.
5. Suspension and takedown
We may suspend or remove a site, or suspend an account, if we reasonably believe it breaks these terms or the law, receive a valid complaint or legal order, or need to protect visitors or our service. Where practical and lawful we will tell you why and give you a chance to respond; for serious harm such as phishing we may act immediately. Anyone can report a site using the "Report" link on every site.
6. Availability and changes to the service
We work to keep Komers Sites available and secure, but we do not guarantee uninterrupted service. Keep your own copies of important content and export your form records regularly. We may change or discontinue features; if we discontinue the service we will give at least 30 days' notice by email and refund unused purchased credits.
7. Third-party services
AI apps, payment providers, Google sign-in and other third-party services are provided by their owners under their own terms. We are not responsible for them, including for what an AI app generates or does with data it reads through the connector.
8. Liability
To the extent allowed by law, Komers Sites is provided "as is", and we are not liable for indirect or consequential losses, lost profits, lost data or business interruption. Our total liability to you for any claim is limited to the amount you paid us in the 3 months before the claim. Nothing in these terms excludes liability that cannot be excluded under Malaysian law.
You will compensate us for losses arising from your content, your sites' handling of visitors' personal data, or your breach of these terms.
9. Ending these terms
You can stop using Komers Sites at any time and ask us to delete your account at —. We may end these terms by notice if you seriously or repeatedly breach them. When your account ends, your sites are unpublished and deleted, subject to the retention periods in our Privacy Notice.
10. Changes to these terms
We may update these terms. For significant changes we will email you at least 30 days before they take effect; continuing to use Komers Sites after that means you accept them. This version: 2026-10-30.
11. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction. If there is any inconsistency between the English and Bahasa Malaysia versions, the English version prevails. Contact: Komers Sites operator (set LEGAL_COMPANY_NAME), —, —.
12. Taking payments on your site (seller terms)
These extra terms apply if you turn on payments for a site. Your customers pay through Komers Sites operator (set LEGAL_COMPANY_NAME) using CHIP (FPX online banking and DuitNow QR). Komers Sites operator (set LEGAL_COMPANY_NAME) receives the money as your collection agent and pays it to the bank account you add in the dashboard.
- You are the seller. You are responsible for what you sell, its price, delivery, taxes (including SST where it applies), receipts to your customers and complying with consumer protection law, including the Consumer Protection (Electronic Trade Transactions) Regulations 2012. Show your business name, contact details, prices and refund policy on your site.
- Fees are shown on the Payments page in your dashboard and are deducted from each sale: a payment gateway fee, a platform fee and, if any, a payout fee. Fee changes are notified at least 30 days in advance and apply only to later sales.
- Each sale is held for a few business days (shown on the Payments page) to cover refunds and disputes, then paid to your bank account once your available balance reaches the minimum payout. Your first payout, and the first after you change bank details, is checked by our team before it is sent.
- Refunds you make return the full amount to the customer. Before payout the sale is cancelled; after payout the amount is deducted from your next payouts. The payment gateway fee is not returned by the bank, so it is taken from your balance. Chargebacks and disputes are handled the same way.
- We may hold or delay payouts, refund customers, or turn off payments for a site if we reasonably suspect fraud, prohibited goods or services, a breach of these terms, a high level of complaints or disputes, or if the law or our payment providers require it. Selling anything listed in section 4, or regulated goods and services you are not licensed to sell, is not allowed.
- You must give accurate bank and identity details for an account in your own name or your business's name. You agree that we and CHIP may verify them. If money is owed to us (for example, refunds after payout), we may deduct it from future payouts or ask you to pay it.
- You cannot delete a site while money is held for it or owed from it. If payments stop, we pay out any remaining balance after the holding period, minus amounts owed.
